Categories of documents produced and/or managed, coform the law:

The release of the identity card when reached the age of 14

Necessary documents:

  • application for the release of the identity card signed by the minor but also by the parent ( or legal representative
  • birth certificate ( original and Xerox copy )
  • identity card of one of the parents, of the legal representative or legal guardian that proves the current residence
  • receipt for the identity card value (7 lei)
  • 1 leu fiscal stamp

The persons that are over 18 years will have to give a statement that will result the reasons of remaining illegal until that age and will annex 3 photographs B.I type and will present the documents that prove the current residence ( original and copy).

Lost, stolen, deteriorated or destroyed identity cards

Necessary documents:

  • application for the release of the identity card in which the citizen will mention that in terms of 48 hours from finding the card will be present in order to resolve the situation
  • in the case of theft, the proof from the police station where the theft was announced
  • birth certificate and marriage certificate ( if necessary) original and copy
  • divorce paper ( if necessary) original and copy
  • papers that proves the current residence, original and copy
  • receipt for the identity card value (7 lei)
  • fiscal stamp that costs 4 lei.

Residence changing, re-named street or renumbering the real estate

Necessary documents:

  • Application for the release of the identity card
  • Previous identity card
  • Birth certificate and wedding certificate ( if necessary) original and copy
  • Divorce paper (if necessary) original and copy
  • Death certificate of companion ( if necessary) original and copy
  • Birth certificate of children under 14 years ( if necessary) original and copy
  • Military paper or any legal proof if the applicant has military duty
  • Receipt receipt for the identity card value (7 lei) Fiscal tax stamp that costs 1 leu.

Temporarily id card will be releasedunder the following circumstances:

  • Citizen doesn’t have all of the documents needed for the release of the id card
  • Citizen is living in a litigious house
  • When the mechanisms for the production of id cards aren’t working

Necessary documents:

  • 3 photographs 3x4cm, with a 7mm band at the bottom
  • documents that can be shown, conform the law, and can prove the name, civil status, citizenship, residence ( original and copy)
  • Receipt for the identity card value (7 lei)
  • Fiscal tax stamp that costs 1 leu (and if the old id card is stolen, deteriorate, lost or destroyed, it has the value of 4 lei).

Settlement or re-settlement of one’s residence in Romania

Necessary documents:

  • application for the release of the identity card ( for minors the application will be signed by a parent also)
  • application for the establishment in Romania
  • In the case of only one parent establishing it’s residence in Romania, the consent of the other parent in authentic form from the registrar  or the copy from the irrevocable juridical decision  which confirms that the children are left to the aprent that is moving to Romania
  • birth certificates and marriage certificate ( if necessary) 
  • birth certificate for the children under the age of 14  released in Romania original and copy
  • divorce paper (if necessary) original and copy
  • papers that proves the current residence, original and copy
  • Romanian passport, valid, original and the copy of the first 3 pages or the receipt released by the  Service of Migration problems and Citizenship, part of the Passport General Direction, or the certificate of ascertainment  that will prove the quality of citizenship, released by the Ministry of Justice or the Consulate office from abroad, in original and 3 Xerox copies. 
  • 3 photographs 3x4  with a whiter 7mm band 
  • receipt for the identity card value (7 lei)
  • CEC receipt showing that you’ve paid the consulate tax (not necessary in the case of foreign persons that have received Romanian citizenship)
  • CEC receipt for the registration  of the “ establishment in Romania application” (not necessary in the case of foreign persons that have received Romanian citizenship)
  • fiscal stamp that costs 1 leu

The Evidence of residence can be made with one of the following documents:

a. documents validated according to the current romanian legislation

b. a written declaration of reception by your host along with the document of the host of the individual

c. declaration on the own responsibility of the solicitant, along with a verification note by the policeman of public order through which the existence of a space is confirmed and that the solicitant lives  at the specific address and that it wasn’t found a rightful owner, for the persons that didn’t complete the a.b. points. For the minors under interdiction, the declaration is signed by the parents of by the legal tutor.

d. The document emitted by the town hall from which it results that the solicitant figures in the agricultural register

Determinating the residence

Necessary documents:

  • application for determining the residence
  • the id card of the solicitant
  • birth and marriage certificates ( if needed_
  • birth certificate for the children under the age of 14 that will live in the residence
  • id card of the host
  • document that can result that the solicitant have the residence assured at the specific adres
  • fiscal stamp that costs 1 leu

Documents necessary for the eliberation of the certificate attesting the residence and the Romanian citizenship

Inspectoratul National pentru Evidenta Persoanelor (National Inspectorate for Persons Records ) releases by the Romanian Government’s Ordinance number 33/2002, as it was approved, with changed due to the law number 223/23.04.2002 and the order of Administration and Internal Minister number 696/05.09.1997. the certificate that certifies the residence and Romanian citizenship.

Necessary documents

  • written application in which the solicitant will mention the reason and the country in witch it is necessary the attesting certificate of the residence and the Romanian citizenship
  • copy of the id card 
  • receipt of the consulate tax worth 22 lei. It can be paied at CEC or at the following account M.A.I. COD IBAN RO 79 TREZ 701202101004 CONT 202101044992963.
  • special acquirement in original or Xerox copy from a public registrar or from a foreign registrant, but it has to have the application conform the Haga Convention, acquirement consisting of the certificate that certifies the residence of the dwelling and citizenship in Romania

Obtaining Romanian citizenship

Necessary documents:

  • Application for the release of the id card ( for minors the applications will be signed by parents)
  • Certificate consisting in obtaining the Romanian citizenship released by the Justice Minister or the official consulate of romania from abroad ( original and 2 Xerox copies) 
  • Birth and marriage certificates ( if needed ), birth certificates for the children under 14 years, released by the Romanian authorities ( in original and Xerox copy)
  • Divorce decision (if needed) in original and Xerox copy
  • Documents that will attest the residence 
  • A document with photograph that will prove the identity of the person, in original and copy ( foreign identity card, passport, drivers license etc. )
  • Receipt for the identity card value (7 lei)
  • Fiscal stamp that costs 1 leu
  • Pass released by the Authority for Foreign that will be delivered at the date it will be released.

NOTE

Judicial Divorce decisions released abroad ( in original, Xerox copy and legalized translation) will be first registered by the marital status of Romania, and the citizenship will present at the Office of Persons Records the birth certificates and marital ( if needed) with the special mention written on them.

Counter-value of the taxes at the Public Services of Persons Records are as following:

  • Counter-value id card – 7 lei
  • Counter-value temporary id card – 1 lei
  • Data supply – 1 leu / person
  • Romania (re)establishment tax – 41 lei
  • Tax for releasing the certificate of residence and citizenship – 22 lei
  • Tax for recording persons on the Romanian territory, solicited by the foreign people – 35 lei / person

IDENTITY CARD WILL BE RELEASED AS FOLLOWING:

The first identity card is released at the age of 14 years.

  • The first identity card is released at the age of 14 years.
  • For the persons with the age between 14-18 years, the validity term of the id card is of 4 years
  • For the persons between 18-25 years, the validity term of the id card is of 7 years
  • The id card released for persons over 25 years have 10 years validity
  • After reaching 55 years, the id card is released with permanent validity term. 

The Supply of Data from the National Inspectorate for Persons Records

Legal entities can ask, after a written solicitation justifying the solicitation, the communication of oersonal data from the National Register of Persons Records, but only referring to:

  • marital status data ( name, surname, date and place of birth, name and surname of the parents of the certain person
  • date referring to identity card about the referring person
  • data about the current residence 
  • data according to the personal code
    The activity of  supplying some data with personal information from the National Register of Persons Identification is adjusted by OUG nr.97/2005 according to the evidence, the residence and identity cards of Romanian citizens, Government Decision nr.113/1997 according to the content, actualization of the data from the National Register of Persons Records with the complementary completations, also by the Law number 677/2001 for the protection of the persons according to the processing and circulation of the personal data.
    According to this indenture, attaining personal data can be obtainable only by having a written consent form the specific person
Necessary documents to register a birth:

1. Medical certificate that consented the birth

2. Birth certificate and the id card of the mother and the declaring person, if the birth isn’t declared by the mother

3. Marriage certificate if the parents are married

4. Declaration written by both parents from which it can result the family name of the child ( if the parents have different family names) and a surname ( if there is a misunderstanding between the surname in the medical certificate and the verbal declaration).

Birth registrations can be taken at the Marital Status Service at the City Hall

Term of registration of the birth and the registration of the child:

1. 15 days  from de day of birth for a baby born alived and still alive

2. 3 days from the day of birth if the baby is born dead

3. 48 hours from the day of death for the child born alive but died in within the period of 15 days

If the declaration is made after the legal term expired but within a year from the day of birth, the registration will be made with the mayor’s approval and the reason of the delay will be mentioned.

Necessary documents for termination of marriage:

I. Between Romanian citizens:

1. Marriage declaration;

2. Id cards;

3. Birth certificate, original and copy;

4. Medical certificate mentioning the state of health ( available 14 days after the release and with the express mention that the person can marry);

5. Documents, original and copies, translated and legalized that consists of the cancellation of the previous marriage:

- Death certificate of the previous spouse;

- Separation or divorce certificate;

- Birth or marital certificate, mentioning the cancellation of the marriage

The marriage will be terminated at the local council.

II. Between a Romanian citizen and a foreign one:

The documents enumerated at the first point and also:

1. Evidence released by the Diplomatic Missions or Consulate Offices from Romania

2. Declaration based on fully responsibility and approved by a local notary that the future husband isn’t married and has the abilities required by the national law to perform the marriage.

3. Official record written with an authorized translator in the case of a marriage between persons that don’t speak Romanian or are deaf-mute

4. Approval of the Ministry of Defence, M.I, Ministry of Justice or of the state services conduction specialized in defending the national security, in the case of active military persons that marry a stateless person or a person that doesn’t have only Romanian citizenship.

The marriage will be terminated at the local town hall

III. Between foreign citizens:

Documents named at points I and II

The marriage will be approved at the local council.

DOCUMENTS NEEDED TO REGISTER A DEATH

1. Medical certificate that consented the death signed by the doctor or medical team that found the death

2. Id card of the deceased

3. Military certificate ( if necessary) for the persons that had military obligations

4. Passport, id card or temporary pass in the case of a foreign citizen

5. Proof  released by the police in which it consents that they have been announced of the death ( if the death is caused by a suicide, an accident or any other violent cases, also if the body is found)

6. Proof released that the case of death wasn’t announced or registered in legal terms

7. Court’s decision of a death declaration is permanent in the case of a person disappearance.

The Declaration of death is made orally in terms of 3 days from the death of the person. In this period it is included the day the person died and also the day of the declaration.

The registration of the death is made at the Service of marital status in the near-by city council

Documents necessary for the transcription of the marital certificates released by the foreign authorities:

Marital Certificate or it’s copy translated and legalized by a public notary from the country or from Romanian Consular Department, also justified documents for the completion of some chapters.

Marital Certificates of Romanians made in foreign countries can be transcript in terms of 6 months from the return in the country or from the receival of the certificate from abroad.

The application for the transcription is made at the local council near the solicitant’s residence.

Romanian citizens having  residence in other countries can ask for the transcription directly or with special approval , authenticated in  Romania by a publc notary or, abroad, by the Romanian Consular Department from the resident state. In this case, the application is made at the local council where he once lived in Romania or, if he have never been a resident, at the locat council sector 1, Bucharest.

The Approval of transcriptions are made by the General direction of Persons Records

Documents necessary for name-changes or surname-changes:

1. Legalized copies of the marital status certificate of the person that applied for the change

- birth certificate

- marital certificate

2. Consent given by the other companion in the case of changing the common family name used during a marriage

3. Copy from the decision of  receiving guardianship as the law follows

4. The criminal record of the solicitant

5. Fiscal record of the person

6. Any other documents that the solicitant considers appropriate for the application

7. B.I/C.I copy

8. Passport copy

9. Notoriety declarations ( if necessary) given in original form

The application for name-changing is deposited at the Public Service Community of Personal Evidence, in the near by surroundings of the person’s residence.

The applications for the persons without Romanian citizenship are solved using the same methods as the ones for Romanian citizens.

Romanian citizens with their residence in other countries will present instead of the fiscal record  an authetic declaration in which they have to declare that they have no debt towards the Romanian State.

The Declaration will be received by a public notary in the country or if it the person is in another country at the Romanian Dimplomatic Mission form the specific country or at a public notary from abroad,  but respecting the Haga Convention

Romanian citizens that never lived in Romania will apply their application at the Public Service for People’s Evidence from the Capital.

The application can be deposited personally or with a special methods, and if it’sa given abroad at the Diplomatic Mission from the resident country or at a public notary, but conform the Haga Convention.
